These Terms explain your rights regarding your inputs and generated outputs, your responsibilities when using the Services, and other important legal information.

We reserve the right, at our sole discretion, to update these Terms at any time. Updates may be communicated via our website, email, or other appropriate means. If you do not agree with any changes, you must immediately cease using the Services and request termination of your account. Continued use after updates constitutes acceptance of the revised Terms.

II. Use of Our Services

1. Prohibited Conduct
You must not:

Reverse engineer or extract source code, models, training data, weights, or algorithms

Scrape, mine, or automate the extraction of Outputs

Use Outputs to train competing AI systems

Circumvent safeguards or security measures

Misuse the Services to deceive, harm, or infringe third-party rights

Use prompt injection or jailbreak techniques

Abuse, disrupt, or overload the Services
2. Usage Policy
You agree not to:

Compromise infrastructure or national security

Generate political campaign content

Promote violence, extremism, terrorism, or hate

Create sexually explicit or disturbing content

Harm children

Violate privacy or identity rights

Spread misinformation

Provide professional medical, legal, or financial advice
3. Commercial Use
Unless explicitly authorised in writing, the Services are provided for personal, research, and experimental purposes only.

III. User Content
1. Prompts and Outputs
You may submit text, files, or materials (“Prompts”). The AI may generate responses (“Outputs”). Together, these are “User Content.”
You represent that:

You have all the necessary rights and permissions.

Prompts do not violate laws or third-party rights.

Prompts are not illegal, defamatory, harmful, confidential, or malicious.
You are solely responsible for your User Content.
We may remove content that violates these Terms.
2. Ownership
You retain ownership of your Prompts. Subject to compliance with these Terms, we assign to you any rights we may hold in Outputs generated for you.
Outputs may not be unique.
3. Licence to Cognivine Labs
You grant us a worldwide, non-exclusive, royalty-free, transferable, sublicensable, perpetual licence to use, host, store, modify, analyse, and process User Content to:

Provide and improve Services

Develop AI systems

Ensure safety and compliance
4. Reliance on Outputs
You acknowledge that:

Outputs may be inaccurate or incomplete.

You must independently verify Outputs.

Outputs are not professional advice.

Outputs must not be used for medical, legal, financial, employment, credit, housing, insurance, or high-risk decisions.
IV. User Feedback
If you provide feedback, we may use it freely without compensation. Feedback is non-confidential.
V. Intellectual Property Rights
All rights in the Services (excluding User Content) belong to Cognivine Labs or its licensors.
You receive a limited, revocable, non-exclusive licence to use the Services in accordance with these Terms.
You may not use our name, logo, or trademarks without written permission.
VI. Personal Data Protection
Your use of the Services is subject to our Privacy Policy.
You represent that you have obtained the necessary consents before submitting personal data of third parties.
VII. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW:

We disclaim all warranties, including merchantability, fitness for purpose, non-infringement, and reliability.

We do not guarantee uninterrupted or error-free operation.

Use of Outputs is at your sole risk.
VIII. Liability
To the maximum extent permitted by law:

We are not liable for indirect, incidental, special, punitive, or consequential damages.

Our total liability in any calendar year shall not exceed the greater of:

Fees paid by you in that year; or

USD $100.

Claims must be brought within one (1) year.
You agree to indemnify and hold harmless Cognivine Labs and its officers, employees, and affiliates from any claims arising from:

IX. Force Majeure
We are not liable for delays or failures due to events beyond our reasonable control, including natural disasters, internet failures, cyber-attacks, labour disputes, government actions, or war.
